Welcome to Ezitec Security & Automation ("Ezitec", "we", "us", "our"). These Terms and Conditions ("Terms") govern your use of our website ezitec.com.au (the "Site") and the services we offer. By accessing or using our Site and services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Site or use our services.
1. Definitions
- "Client," "You," "Your" refers to you, the person accessing this website and accepting the Company's terms and conditions.
- "Services" refers to all products, services, installations, consultations, and support provided by Ezitec, including but not limited to security systems, automation solutions, ICT services, and assistive technologies.
- "Site" refers to the Ezitec website, accessible at ezitec.com.au.
2. Use of Our Site and Services
2.1. Eligibility
You must be at least 18 years of age to use our Services or enter into any agreements with us. By using our Services, you represent and warrant that you meet this age requirement.
2.2. Account Registration
Certain services, such as access to a client portal or specific support features, may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
2.3. Lawful Use
You agree to use our Site and Services for lawful purposes only and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site or Services. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our Site.
3. Quotations, Orders, and Payment
3.1. Quotations
All quotations provided by Ezitec are valid for a period of 30 days from the date of issue, unless otherwise stated in writing. Quotations are based on the information provided by you at the time of quoting. Any changes to the scope of work requested by you may result in a revised quotation and additional charges.
3.2. Orders
Acceptance of a quotation and placement of an order for Services constitutes a binding agreement to these Terms. We reserve the right to accept or reject any order at our discretion.
3.3. Payment Terms
Payment terms will be specified in your quotation or invoice. Typically, a deposit is required before work commences, with the balance due upon completion of the Services, or as otherwise agreed in writing. For ongoing services, payment terms will be as per the service agreement. Late payments may incur interest at a rate of 2% per month on the outstanding amount, or the maximum rate permitted by law, whichever is lower.
3.4. Title of Goods
Title to any goods, equipment, or materials supplied as part of our Services does not pass to you until full payment for those goods and related services has been received by Ezitec. Risk in the goods passes to you upon delivery to your premises.
4. Installation and Services
4.1. Site Access
You agree to provide Ezitec's employees, contractors, and agents safe and unobstructed access to your premises as reasonably required for the purpose of consultation, survey, installation, maintenance, and repair of Services during agreed-upon times. Failure to provide access may result in delays and additional charges.
4.2. Client Responsibilities
You are responsible for ensuring that your premises are suitable for the installation and operation of the agreed Services. This includes providing any necessary power supply, internet connectivity, or existing compatible infrastructure, unless it is explicitly stated in our agreement that Ezitec will provide such. You are also responsible for obtaining any necessary permissions, licenses, or consents (e.g., from landlords, strata management, local councils) prior to the commencement of work.
4.3. Completion and Delays
Ezitec will use reasonable endeavors to complete Services by any estimated completion date. However, such dates are estimates only, and we will not be liable for any delays due to circumstances beyond our reasonable control, including but not limited to supplier delays, adverse weather, or unforeseen site conditions.
5. Warranties and Disclaimers
5.1. Product Warranties
Products and equipment supplied by Ezitec are generally covered by the respective manufacturer's warranties. Ezitec will, where possible, pass on the benefit of such warranties to you and assist with warranty claims as per the manufacturer's terms. Details of specific product warranties will be provided upon request or with the product documentation.
5.2. Workmanship Warranty
Ezitec provides a warranty on its installation workmanship for a period of 12 months from the date of completion. This warranty covers defects arising directly from faulty installation practices by Ezitec. This warranty does not cover damage or defects caused by misuse, neglect, accident, acts of God, modifications by unauthorized third parties, normal wear and tear, or failure to follow operating or maintenance instructions.
5.3. Disclaimer of Other Warranties
Except as expressly stated in these Terms or as required by applicable law (including the Australian Consumer Law), Ezitec makes no other warranties, representations, or guarantees, express or implied, regarding the Services or the Site. The Site and its content are provided "as is" and "as available" without any warranties of any kind, including that the Site will operate error-free or that the Site, its servers, or its content are free of computer viruses or similar contamination or destructive features.
5.4. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
6. Limitation of Liability
6.1. General Limitation
To the maximum extent permitted by law, Ezitec, its employees, agents, or contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or in connection with your use of the Site or Services, whether based on contract, tort, negligence, strict liability, or otherwise, even if Ezitec has been advised of the possibility of such damages.
6.2. Australian Consumer Law Limitation
Where liability cannot be excluded under the Australian Consumer Law, Ezitec’s liability is limited, at our option, to the repair or replacement of goods, the supply of equivalent goods, the resupply of services, or the cost of having the goods repaired or services resupplied.
6.3. Service Interruptions
Ezitec is not responsible for any interruptions to Services caused by factors beyond our control, including but not limited to power outages, internet service provider failures, or equipment malfunctions not attributable to Ezitec’s negligence.
7. Termination of Services
7.1. Termination by You
You may terminate any ongoing service agreement with Ezitec by providing written notice as specified in the service agreement. Termination may be subject to payment for services rendered up to the date of termination and any applicable early termination fees as outlined in the agreement.
7.2. Termination by Ezitec
Ezitec reserves the right to suspend or terminate your access to the Site or Services at our discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is unlawful. We may also terminate services for non-payment or breach of any service agreement terms.
8. Intellectual Property
All content on the Site, including text, graphics, logos, images, and software, is the property of Ezitec or its licensors and is protected by Australian and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent, except for personal, non-commercial use.
9. Privacy

10. Governing Law and Jurisdiction
